RE: MOTION TO DISMISS OR FOR RELIEF FROM THE AUTOMATIC STAY

This cause is before the Court on the motion of David Broyles and John Ball (Movants) who seek dismissal of the Chapter 11 Petitions, relief from the automatic stay as to their claims, or appointment of a trustee. The gist of the complaint is threefold: one, should the Court dismiss these two petitions pursuant to 11 U.S.C. § 305, are these entities proper debtors within the meaning of the Bankruptcy Code and three, are their petitions filed in good faith?
