BEER, Judge.

All Star Insurance Corporation, (hereafter, All Star) was the fire insurer of Franklin D. Paul (hereafter, Paul) covering the contents of a building at 1501 Governor Nicholls Street in New Orleans. Certain of the contents of the building were damaged and/or destroyed by fire on October 15, 1973. As a result of this loss, a settlement was made between Paul and his insurer, resulting in All Star issuing draft Number 23388 dated November 21, 1973, in the amount of $6,895.25, payable to *693the order of Franklin D.
