The claim seeks to recover damages against the State of New York for an alleged false arrest, false imprisonment, malicious prosecution of the claimant, and for an assault upon his person, by a State trooper.
On the evening of July 7, 1974, as the claimant was approaching the tollbooth at Exit 46 of the New York State Thruway, a State trooper’s vehicle, suddenly and without warning, made a U-turn in front of his car.
