Before the Court is the plaintiff City of Attleboro’s (the “City’s”) motion for judgment on the pleadings on its appeal of the order of the defendant Massachusetts Civil Service Commission (the “Commission”) invalidating the City’s decision to terminate the defendant William Dunn’s (“Dunn’s”) employment as a firefighter. The City had terminated Dunn on account of his alleged misrepresentation of his physical abilities in connection with his then being on disability status.
