INTRODUCTION AND PROCEDURAL BACKGROUND

David Carlson (“Carlson”) and Katherine Carlson (collectively “Debtors”) filed a voluntary joint petition for chapter 7 relief on April 17, 2009. On July 20, 2009, Jeffrey Fetty (“Plaintiff’) timely filed a complaint commencing this adversary proceeding against Debtors seeking to establish the nondischargeability of a debt under § 523. 2 Adv. Doc. No. 1. The complaint also named as a defendant DL Carlson Enterprises, Inc., dba Cottman Transmission (“Cottman”). 3
