SMITH, Judge.

Plaintiff, Delfino Montoya, appeals the summary judgment entered dismissing his complaint against defendants, Local Union III of the International Brotherhood of Electrical Workers (Local III), and Robert H. Mason,, business manager of Local III. Mason and Local III cross-appeal the trial court’s denial of their request for attorney fees for Montoya’s frivolous litigation. We affirm in part and reverse in part.
