delivered the opinion of the court.
Plaintiff in error brought suit against defendant in error . to recover damages for injuries sustained by him, caused, as he alleges, by the negligence of the defendant. At the request of the defendant, and at the close of the plaintiff’s case the trial court gave to the jury a peremptory instruction to> return a verdict for the defendant.
On this writ of error the plaintiff questions the correctness of the foregoing ruling.
