Plaintiff Tracey Burnstein commenced this suit on June 1, 2001, alleging that Defendants Saks Fifth Avenue & Co. and McRae’s, Inc., 1 violated the federal Fair Credit Billing Act (“FCBA”), 15 U.S.C. § 1666 et seq., by failing to appropriately respond to and correct a purported double-billing error identified by Plaintiff, and by reporting Plaintiffs account to a credit bureau as delinquent despite the disputed status of this account.
