SERB dismissed relators’ unfair labor practice charge upon a finding that there was no probable cause to believe that an unfair labor practice had been committed by the university in connection with the privatization of the hospital. Relators contend that SERB abused its discretion in this regard. Specifically, relators urge that SERB’S determination of no probable cause was arbitrary and erroneous, since, according to relators, SERB was presented with evidence establishing probable cause that an unfair labor practice had been committed by the university.
