On February 29, 1912, defendant in error filed a motion setting up the failure of plaintiff in error to file briefs, and praying as follows: “First. To affirm the judgment of the court below, with statutory damages, and judgment against the sureties on the appeal and-supersedeas and writ of error bonds. Second.
