This action was brought by Henry Folkers, hereinafter referred to as relator, in the Circuit Court of the City of St. Louis to have that court issue a writ of mandamus commanding Charles A. Welsch, Building Commissioner of the City of St. Louis, wbo will be referred to as respondent, to grant a permit for the erection of a gasoline filling station on certain real estate located in the City of St. Lonis.
