Appellant Duane Wilson was charged with the December 26, 2002 murder of Trishawn Fifer. A jury convicted Wilson and sentenced him to thirty years in the Institutional Division of the Texas Department of Criminal Justice. The evidence at trial consisted primarily of statements made by the victim’s four year old daughter, Wilson’s inconsistent statements, witness accounts of activity at the victim’s residence and Wilson’s cellular phone records.
