The principal issue presented is whether 42 U.S.C. § 1981 protects an Iranian national from discrimination by those who believe him to be of a race other than white. A woman and her husband, a native and citizen of Iran, sued her former employer and the union that was her collective bargaining agent on the grounds that (1) her discharge resulted from her employer’s prejudice against her husband because of his race and national origin, conduct proscribed by the Civil Rights Act of 1866, 42 U.S.C. § 1981, and (2) the union, in presenting her grievance,…
