MEMORANDUM OPINION AND ORDER

CEDARBAUM, District Judge.

Edward F. Gonzalez petitions for a writ of habeas corpus pursuant to 28 U.S.C. § 2254, challenging the lawfulness of his state conviction. On February 22, 1995, Petitioner was convicted of grand larceny in the second degree. On April 4, 1995, he was sentenced to a term of imprisonment of three and one-third to ten years and ordered to make restitution of $257,203.10 to the victim.
