This adversary proceeding came on before the Court on the Plaintiffs motion for summary judgment on his claims against Defendant NetBank (“NetBank”). Plaintiff Charles W. Ries (“the Trustee”) appeared as counsel for the bankruptcy estate. NetBank appeared by its attorney, Thomas F. Miller.
