Steven Pettit, Robert Carr, Jr., and Gerald Rein were charged by information in the circuit court of Winnebago County with home invasion (Ill. Rev. Stat. 1981, ch. 38, par. 12 — 11(a)(1)), and Pettit was also charged with aggravated battery. Ill. Rev. Stat. 1981, ch. 38, par. 12— 4(b)(1).
Pettit’s motion for severance was granted. Carr and Rein were convicted in a bench trial, and Pettit’s trial proceeded immediately thereafter before the same judge. Pettit was convicted of both charges. Each defendant’s post-trial motion was denied; Carr and Rein were each sentenced to eight years’…
