MEMORANDUM OPINION

MICHAEL, District Judge.

This action was brought on behalf of a learning disabled child by his parent, seeking the child’s readmission into school during the pendency of a 29-day suspension from school for disciplinary problems. Included was a claim for attorney’s fees. Although jurisdiction is an issue in the case which will be addressed herein, this action was brought under 42 U.S.C. § 1983 (1982), 42 U.S.C. § 1988 (1982), 28 U.S.C. § 1343(3-4) (1982), and pursuant to the Education for All Handicapped Children Act of 1975 (EAHCA), 20 U.S.C. § 1401-1461, 1415(b)(2), (c),…
