Plaintiff has appealed from a judgment for the defendants in an action to recover damages for personal injuries sustained by plaintiff under the following circumstances :

On July 1, 1940, at about the hour of 4:25 a. m., plaintiff was walking in a northerly direction on the' easterly sidewalk of Front Street, between Washington and Jackson Streets, in San Francisco, and more particularly in front of the premises known as 522 Front Street.
