This is an action brought by the plaintiff, a resident and house owner and occupant in the village of Pelham Manor, Westchester county, against the defendant, to permanently enjoin the defendant from exacting from the plaintiff payment of charges for supplying water to plaintiff’s premises, within said village, in excess of certain specified rates, and also permanently enjoining the defendant from refusing to supply water to plaintiff’s said premises.
