The Chancellor:
On July 6, 1874, the complainant filed his original bill, claiming to be a creditor of the defendant, Jennings, by foreign judgment, by note, and by account, and asking for an attachment of the defendant’s estate upon *132the ground that he was a non-resident of the state. A fiat was obtained, and attachment issued and was levied, on the same day, upon a lot in Nashville.
