Eagle Fund, Limited (Eagle), a Cayman
Islands-based investment corporation, alleged that the defendant, Karlis Sarkans, misrepresented material facts in connection with the sale of securities in violation of Massachusetts and *80Washington State securities laws. A Superior Court judge entered a default judgment of liability against Sarkans for. his failure to comply with court-ordered discovery. Sarkans appealed from entry of the default judgment and from the denial of his motion for summary judgment on the securities claims.
