This petition was answered by Stephen A. Ryan ; and a hearing was had before Judge Gober, whose dedecision, on July 28, 1891, was, in brief, as follows : It appeared that heside the money turned over by Ryan to the temporary receiver, he turned over a book of Atlanta National Bank checks, the stubs of which for checks used began with 461 and ended with 493, dated May 26, 1891; also a book of checks of Eugene Kelly & Company, from which checks had been used to 949, dated' May 24, 1891.
