The instant appeal has a rather complicated history, a summary of which is necessary to the resolution of the issue presented.

Appellee-plaintiffs, the Carlins, instituted suit against appellant-defendant, Cohran, a practicing attorney. Subsequently, the Carlins sought to depose Cohran in connection with their pending action.
