Affirming.
W. H. Hightower, W. B. Jones, and a number of others were indicted in Harlan county for the murder of James Daniels, and it was charged in the indictment that they willfully and feloniously, and with malice aforethought, entered into a conspiracy with each other and other persons, to the grand jury unknown, to murder James Daniels and other persons, to the grand jury unknown, and that, as a result of the conspiracy, and pursuant to it, one or more of the defendants or other persons acting with them, in furtherance of the conspiracy and…
