This suit was instituted in the district court of Wichita county, Tex., on November 2, 1925, by the appellant, C. Wake-field, against the appellees, Frank Queisser, doing business under the trade-name of Overland Motor Company, and the Standard Accident Insurance Company, a corporation, seeking to recover actual and exemplary damages, aggregating the sum of $2,980.
