Appeal from an order and an amended order of the Supreme Court (Krogmann, J.), entered February 19, 2014 and April 4, 2014 in Warren County, which, among other things, denied defendant’s motion for summary judgment dismissing the complaint.
Plaintiff sustained a brain injury in August 1991 when, while a pedestrian, he was struck by a vehicle operated by defendant.
