Appellant was convicted by a jury of the offense of delivering a controlled substance with intent ot sell and a term of 8 years’ imprisonment was imposed. On appeal from the judgment he urges numerous points for reversal We are persuaded the case must be reversed on appellant’s contention the trial court erred in denying his pretrial motion to dismiss because he was not tried within three terms of court as required by Rule 28.1, and therefore we discuss only this point.
