Action by William E. Thompson, as administrator of the estate of John Thompson, deceased, against Benjamin E. Wallace and another. Prom a judgment for plaintiff for $2,000 against said Wallace, he appeals.

Appellee brought this action in the Porter Superior Court against appellant and the Grand Trunk and Western Railway Company, to recover damages resulting from the death of John Thompson. The issues formed by the amended complaint were submitted to a jury, which returned a verdict in favor of appellee and against appellant. At the conclusion of the evidence the defendant railway company moved that the court instruct the jury to return a verdict in its favor, which motion was sustained, and a verdict returned in favor of said defendant.
