MEMORANDUM OPINION

Plaintiff Ark Plas Products, Inc. (“Ark Plas”) has filed this declaratory judgment action against defendant Value Plastics Inc. (“Value Plastics”) seeking a declaration of invalidity under the Lanham Act of certain trademarks and trade dress. 15 U.S.C. §§ 1064, 1119.
