HIGGINS, Justice.

This is an action to annul a certain instrument designated as a “Declaration of Ownership,” in which the respective proportionate interests of' the co-owners are set forth, on the ground of alleged error and misunderstanding, and for judgment recognizing the correct proportionate interests of the co-owners.

The defendants denied that an error had been made and that there had been a misunderstanding, and pleaded estoppel against the' plaintiffs, who had signed the instrument, and interposed other pleas and defenses against Roxie Mims Lewis,, one of the plaintiffs, who had not…
