This was an action on the case for an alleged malicious prosecution, brought by appellee against appellant, in the Superior Court of Cook county. There was a jury trial, resulting in a verdict of guilty, with damages assessed at $5,000 for which sum the plaintiff had judgment, and the defendant brings the case to this court by appeal.

It is unnecessary to rehearse the evidence in detail. It appears that appellee was arrested on a warrant issued by a justice of the peace on complaint of appellant, charging him with embezzlement in failing to pay over certain insurance premiums collected by him…
