This is an action of trespass on the case brought in the circuit court of Wood County by Lucy I£. Smith against the Parkersburg Co-Operative Association, a corporation, to recover damages for personal injuries received byfalling into an elevator shaft alleged to have been carelessly and negligently left open in the store room of the defendant company, plaintiff having gone into said store for the purpose of purchasing goods, which defendant was there offering and exposing to sale to the general public.
