Tbe plaintiff appeals from tbe dismissal of bis bill filed to enjoin the defendants, officers of tbe Commonwealth, from enforcing against him tbe provision of- tbe Act of May 31, 1945, P. L. 1198, 52 PS 1396.1, on tbe ground that the act is unconstitutional. It is an Act, as its title states, “Providing for tbe conservation and improvement of land affected in connection with the mining of bituminous coal by tbe open pit mining method; regulating such mining; and providing penalties.” Tbe open pit mining method is also described as strip mining or stripping.
