In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Queens Comity (Raffaele, J.), entered December 16, 2013, which, upon a jury verdict on the issue of liability in favor of the defendant, and upon the denial of his motion pursuant to CPLR 4404 (a), in effect, to set aside the verdict as contrary to the weight of evidence and for a new trial, is in favor of the defendant and against him dismissing the complaint.
