Appeal from a judgment of the County Court of Albany County (Harris, J.), rendered November 26, 1985, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.
On June 16, 1985 at about 4:00 a.m., a Town of Colonie Police officer received a telephone call from a resident of Roberts Drive of “suspicious activity” taking place in that neighborhood.
