— Appeal from a judgment of the County Court of Albany County, rendered January 28, 1980, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the fourth degree. During the evening of June 23, 1979, defendant was stopped by New York State Trooper Guiry for driving 55 miles an hour in a 40-mile-an-hour zone.
