It was claimed by defendant, and the evidence tends to show, that, in the forenoon of August 7, 1922, deceased, Livermore, threw bricks through the windows of defendant’s home, cut the screens, entered the house, and broke up some of the furniture. About 3 o’clock in the afternoon of the same day, defendant was informed of the circumstances just narrated. Defendant returned home, and proceeded to repair the damage; and while he was in the act of rebuilding the fence, Livermore and his wife walked past the place, on their way to a store.
