The plaintiff was injured while assisting in loading a case weighing 1,600 pounds from the floor of a dock in Brooklyn to a truck owned by defendant United States Trucking Corporation and in charge of a driver employéd by said defendant. Defendant Collins, called as a witness for plaintiff, testified that his office was in the borough of Manhattan; that desiring to move the case he went to the office of the trucking corporation, which was also in Manhattan, and told the representative of the trucking corporation that he wanted some freight moved from the pier in Brooklyn to a…
