Appeal from a judgment of the Supreme Court (Breslin, J.), rendered June 21, 2016 in Albany County, upon a verdict convicting defendant of the crime of assault in the second degree.

Defendant was charged by indictment with assault in the second degree stemming from an incident during which a police officer for the City of Albany Police Department (hereinafter the victim) was injured after being sprayed by defendant with a canister of pepper spray while she was responding to a noise complaint at defendant’s residence.
