McCann, J.:

The petitioner, George M. Spawn, was for many years prior to June 30, 1923, division chief in the Bureau of Canal Affairs in the office of the State Comptroller of the State of New York. This position was in the competitive civil service of the State. The petitioner received until the date above mentioned a salary of $4,000. He was an exempt fireman and entitled to all the privileges of such. On the 14th of June, 1923, the State Comptroller addressed a letter to the petitioner notifying him that after June 30, 1923, his services would be no longer needed. No charges were preferred…
