Appellant presents but one question on rehearing. He claims that the court below erred in admitting the testimony of Mrs. Kirby to the effect that before she laid the facts of this case before the prosecuting officers of Tarrant County, at the instance and direction of her husband, she laid the facts before her grandparents at Weatherford and that they advised her, upon her return to Fort Worth, in effect to lay the matter before the prosecuting officers, which she did.
