Plaintiff Maria Del Carmen Méndez (“Méndez”) brought suit against defendant Togo West, Acting Secretary of the Department of Veterans Affairs, pursuant to the Rehabilitation Act (“Act”), 29 U.S.C. 701 et seq.. Méndez alleges that the Department of Veterans Affairs (“DVA”) discriminated against her because of a mental disability by suspending her from work at the Veterans Hospital Outpatient Clinic in Ponce for 14 days, and by transferring her to the Veterans Medical Center in San Juan.
