MARTIN, Justice.

The sole question properly before the Court for review is whether the trial court erred in holding that N.C.G.S. 24-5 vio*412lates the equal protection clause of the fourteenth amendment to the Constitution of the United States and article I, section 19 of the Constitution of North Carolina. We hold that the trial court did err in holding that the statute violates these constitutional provisions.

N.C.G.S. 24-5 (Cum. Supp. 1983) provides as follows:
