WYATT, District Judge.

This is an application for the writ of habeas corpus, 28 U.S.C. § 2241, submitted by Giovanni Rinaldi (Giovanni), who is acting for himself and without counsel. Permission to proceed in forma pauperis was granted by order of Judge MacMahon filed January 18, 1977. 28 U.S.C. § 1915(a).

Giovanni is a twenty-eight year old citizen of Italy who in 1960 entered the United States with a visa for permanent residence. He has been convicted in the New York State courts three times, twice for drug offenses and once for possession of stolen property. Currently, he is serving a five…
