GRISSOM, Justice.

Alexander Trust Estate filed this suit in a District Court of Taylor County against Mrs. Lillie Higginbotham, individually, and as independent executrix of the estate of her deceased husband, E. H. Higginbotham. Alexander Trust Estate had a debt, secured by a landlord’s lien for rent, against E. H. Higginbotham, deceased, amounting to approximately $5,000. The suit was instituted for the purpose of establishing and foreclosing plaintiff’s landlord’s lien against the merchandise in the rented building. Plaintiff attempted under Art. 3515a (Acts 1931, Vernon’s Tex.Civ.St. 1936)…
