The administrator, plaintiff below, has appealed from a judgment dismissing his suit at the close of plaintiff’s proof, a motion for a directed verdict in behalf of the defendant having been sustained. The suit was instituted for the alleged negligent killing of J. Ernest Froman, plaintiff’s intestate. The intestate, a young man, was killed in Memphis, Tennessee, in an automobile collision. The intestate was riding in a ear driven by one James Purvis. The car that struck the Purvis car was operated by Mrs. Kate Washington, wife of the defendant, Dr. C. J. Washington.
