BRATTON, Circuit Judge.

This is the second appeal in this case which involves liability on a policy of life insurance. The cause was remanded on the former appeal with leave to plaintiff to recast her pleading to declare upon the automatic paid-up provision in the policy, and to have the action transferred to the law side of the do'cket. (C.C.A.) 72 F. (2d) 894. An amended complaint was filed and the transfer made.
