Plaintiff sued upon a promise to buy from,the plaintiff stock in the defendant company at the sum of $50 a share. He filed a declaration in three counts, two of which alleged an offer of defendant to buy and acceptance by plaintiff. Defendant filed a demurrer to the declaration.
