The general grounds of the motion for new-trial were abandoned.
The first special ground of the motion for new trial urged that the trial court erred in illegally admitting, and refusing to strike, evidence as to the option signed by Dr. Julia Sutton for the sale of her property to the plaintiff. The first objection of condemnor’s counsel to this evidence was that it was not admissible until it was shown it was exactly similar land.
