MEMORANDUM OPINION

THIS MATTER is before the Court on Plaintiff Theodore Cyprian’s (hereafter “Cyprian” or “Plaintiff’) Motion For Reconsideration, Or In the Alternative For Certification. Plaintiff asserts that this Court committed manifest error of law when, by order dated August 19, 2009, it dismissed Plaintiff’s claims against WAPA after overturning its initial order denying Virgin Islands Water and Power Authority’s (hereafter “WAPA” or “Defendant”) Motion to Dismiss, upon an unprecedented finding that the Virgin Islands Tort Claims Act (hereafter “VITCA” or “Act”) applies…
